Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the eMove software and related services operated by The Room Company GmbH, a company registered in Switzerland (“we,” “us,” or “our”). By using eMove, you agree to these Terms. If you do not agree, please do not use the service.
1. Service Description:
eMove is a digital tool that integrates with Microsoft 365 and Outlook to provide short, guided movement breaks during the workday. The service is designed for professional and organizational use and may be provided through corporate licenses or individual subscriptions.
2. Accounts and Access:
Some eMove features require you to sign in with your Microsoft 365 account.
You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. Access to eMove may be limited to the number of user licenses purchased by your organization.
3. Licensing and Use:
eMove is licensed, not sold. Corporate customers may install and use eMove only for the number of users covered by their subscription. Individual users may access eMove only through valid credentials linked to a paid license. The software and all associated content (videos, images, text, and code) remain the property of The Room Company GmbH. You may not copy, modify, distribute, or create derivative works from eMove content without written permission.
4. Acceptable Use:
You agree not to: Use eMove for unlawful purposes or in ways that could impair the service. Attempt to reverse engineer, decompile, or otherwise extract the source code. Share or resell access to the software outside the scope of your license.
5. Subscriptions, Payment, and Renewal:
Use of eMove requires an active subscription. Corporate subscriptions are billed annually based on the number of user licenses. Non-payment or unauthorized use may result in suspension or termination of access. We reserve the right to update pricing or terms with reasonable notice.
6. Intellectual Property:
All intellectual property rights in the eMove software, including design, videos, text, and trademarks, belong to The Room Company GmbH. No rights are transferred to the user beyond the limited right to use the service in accordance with these Terms.
7. Data Protection and Privacy:
We process personal data in accordance with our Privacy Policy. Data related to the eMove service is securely stored on Microsoft Azure servers located in Western Switzerland. By using eMove, you consent to such data processing and storage.
8. Health Disclaimer:
eMove provides general movement guidance and is not a medical service. Users should listen to their bodies and consult a healthcare professional before starting any new physical activity, especially if they have medical conditions or injuries. We are not responsible for any adverse outcomes resulting from misuse of the exercises.
9. Limitation of Liability To the maximum extent permitted by law:
eMove is provided “as is” without warranties of any kind. We do not guarantee uninterrupted or error-free operation. We are not liable for indirect, incidental, or consequential damages arising from your use or inability to use the service.
10. Termination:
We may suspend or terminate access to eMove if you breach these Terms or fail to pay for the subscription. Upon termination, your right to use the service ceases immediately.
11. Updates and Modifications:
We may update or modify eMove or these Terms from time to time.
Continued use after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law and Jurisdiction:
These Terms are governed by the laws of Switzerland, without regard to conflict of law principles.
Any disputes arising from or relating to these Terms shall fall under the exclusive jurisdiction of the courts of Zug, Switzerland.
